Mullumbuds offers commercial horticultural advisory, sustainable landscape design, soil quality analysis, drip-irrigation modeling, and ecological botanical integration. All services are delivered based on a written scope agreed upon by both parties. No verbal agreements or implied outcomes are binding unless confirmed in writing.
The client agrees to provide accurate site information, grant reasonable access to the property, and disclose any known hazards (e.g., underground utilities, contaminated soil, restricted species). Failure to disclose material facts may void Mullumbuds' liability for related outcomes.
Mullumbuds advises based on current horticultural science and site-specific data. We do not guarantee specific crop yields, plant survival rates, or financial returns. Our liability is limited to the total fee paid for the specific service that gave rise to a claim. We are not liable for indirect damages, including loss of plants, water damage, or business interruption, unless caused by gross negligence.
All reports, designs, models, and recommendations produced by Mullumbuds remain our intellectual property until full payment is received. Upon payment, the client receives a non-exclusive license to use the deliverables for the intended project. Unauthorized reproduction or redistribution of our materials for other projects is prohibited.
Either party may terminate an active service agreement with 14 days' written notice. Upon termination, the client pays for all work completed up to the notice date. Mullumbuds reserves the right to terminate immediately if the client fails to comply with safety or legal requirements.
We may update these terms at any time. Continued use of our services after changes are posted constitutes acceptance of the revised terms. Material changes will be communicated via email or a notice on our website.
These terms are governed by the laws of New South Wales, Australia. Any disputes shall be resolved in the courts of that jurisdiction.
